Topic: Update on Affirmative Action Programs and the Ever-Active OFCCP
Over the past year, sub-regulatory statements from the Office of Federal Contract Compliance Programs have altered best practices for creating and implementing Affirmative Action Programs (“AAPs”). In particular, OFCCP has historically relied on the factors in Nationwide Mutual Insurance Co. v. Darden, 503 U.S. 318 (1992) to guide contractors on whom to include in an AAP. However, the OFCCP’s proposed changes to the Scheduling Letter and Itemized Listing suggest that, to comply with the Scheduling Letter, contractors may have to expand AAP coverage beyond that contemplated by Darden.
