Topics:

8:30am - 9:30am:  Understanding OFCCP's Compensation Directive, the Implications for Conducting a Proactive Self-Analysis of Pay, and the Strategies of Submitting Compensation in a Compliance Review

Compensation Topic Description:  With the publication of its compensation directive in 2018, OFCCP has made it much more transparent for contractors to understand how OFCCP will evaluate compensation during a compliance review.  Contractors have a road map to examine their compensation for gender and race disparities, but there still are nuances and best practices to conducting these analyses.  Josh Roffman and Nora Evans have helped many clients with the compensation portion of their audit submissions since the directive was issued and they will bring experience and insight into this discussion.  They will address pay analysis groups (what they are, and what happens if your workforce is too small to develop them), different types of proactive pay analyses, and will touch on some of the directive’s statistical substance without overwhelming everyone who didn’t take statistics in college.

9:30am - 10:30am:  The Early Resolution Conciliation Process - Lessons Learned from Negotiating an Enhanced Conciliation Agreement

Early Resolution Topic Description:  OFCCP released its Early Resolution Process Directive in November 2018 as a potential win-win for contractors and OFCCP.  If OFCCP found discrimination in the location(s) being audited, the contractor could resolve the audit by agreeing to wrap multiple facilities into the conciliation agreement progress reporting obligation, and the OFCCP would agree not to conduct a compliance review of those facilities during the term of the agreement.   The OFCCP could validate compliance on a far broader scale by having the contractor conduct its own self-audits.   Alissa Horvitz will be discussing how this process and policy played out as OFCCP worked to close aged matters in August and September 2019, the scope of the employer’s self-auditing obligation, and the pros and cons of an early resolution conciliation agreement.
