Topic:  OFCCP Enforcement During The Trump Administration - Check Your Assumptions At The Door

T. Scott Kelly - Shareholder - Ogletree Deakins

Even in this allegedly business friendly administration, The Office of Federal Contract Compliance Programs (OFCCP) continues to advance an aggressive enforcement agenda against federal contractors and subcontractors with notification that it intends to audit 3500 establishments in 2019.  While OFCCP continues to focus on hiring and compensation discrimination, it also is expanding its focus on disability compliance, and has proposed significant changes to what covered contractors must provide in initial audit submissions. In an unprecedented measure to ferret out non-compliance, OFCCP will require all covered contractors to verify AAP compliance.  This session will examine the fast-moving world of affirmative action compliance, discuss noticeable trends, and provide best practices in this nuanced area of law.
