After an unprecedented “Year of Action” from OFCCP, what are the areas that remain challenging to navigate?  As we conduct audit readiness sessions across the country, the main issues we see continue to be in 503 implementation (both communication strategy and technical aspects of implementation) and compensation, with minor perennial issues with applicant disposition codes, disconnect between HRIS data, policies, documentation and reality.  Our discussion this morning will focus on both the two “new” areas (503 implementation and compensation), and the two perennial favorites in the battle for audit readiness.

Invitation to self-identify: implementing self-id form CC-305 in the AAP transition year:  Form CC-305 is being implemented with varying degrees of success by federal contractors across the country and your communication strategy may move the needle from 2% to 20% or more, irrespective of industry or geography.  We’ll discuss how different companies are approaching this requirement.

As many companies move into their first “transition” AAP year since the implementation of the new 503 regs, what questions should you be asking about the technical aspects of your self-id form to ensure your forms are being presented and processed in a manner consistent with the regulatory requirements?

Analyzing Compensation:  Previous sessions have focused on what to submit; today we will focus on what to analyze internally and how has that analysis has changed in the wake of the new scheduling letter.

Applicant disposition codes:  Still using “more qualified applicant selected?”  Adverse impact in hiring practices remains OFCCP’s “bread & butter.”  We’ll talk about why and what questions to ask BEFORE you get an audit.

Audit readiness 101: What do you say you do; do you do what you say you do; and can you prove it?  We’ll talk about the real-world challenges of navigating the shoals between policy, practice, data and reality in compensation, selection practices and good faith efforts.
